Divorce is the statutory process to terminate a marriage legally. "Legal separation" is also available which is the same process except you remain legally married. However, both result in a judgment and decree dealing with all of the necessary issues including child custody, child support, parenting time, spousal maintenance and property division.
The issues of custody, child support and parenting time also occur in paternity matters which involves a determination of the parentage of a child and the respective rights of the parents.
How complex and how expensive the process of divorce is depends upon each fact situation and the propensity of the parties to settle or contest the issues. I have handled divorces from beginning to end in less than a week. On the other hand, some have taken a year and a half with much litigation and expense. You should be aware that the more issues that you are unable to resolve by agreement, the more litigation you will have and that will result in more expense for you. Our office always encourages a client to consider whether a fair and equitable settlement can be achieved since that saves the parties' money, time and emotional aggravation.
Communication between the attorney and client is critical. It is important for the client to provide counsel with as much information and documentation as possible. The client and attorney need to have a complete grasp of the facts and the client needs to be aware of how those facts are affected by the law. Once that knowledge is obtained, a decision can be made with the client on the best way to proceed.
