Fourth Degree DWI In a Fourth Degree DWI, it is stated that it is unlawful for any motor vehicle to be operated in the state of Minnesota, including those on water. If one is under the influence of any controlled substance, a hazardous substance, has a blood alcohol level over .08, or specific controlled substances within their possession.

Each of these comes with its own penalties with the worst being that of a felony and prison and/or fines and the least severe being a misdemeanor with jail time and/or fines.
